State of Viriginia, Fluvanna County

On this 26 day of Augt 1833 personally appeared before the Court of Fluvanna County State of Virginia, Pearce W Melton a resident of the County and State aforesaid aged Seventy years, who being first duly sworn according to law, doth on his oath make the following declaration in order to obtain the benifit of the provision made by the act of Congress passed June 7th 1832. That he served in the Virginia Militia during the revolutionary War under the following named oficers and as herin stated. To wit. That in the year 1780 (as well as he recollects) he enlisted as a private for twelve months, under Captain Micajah Oglesby who then had command of the Waggon masters department, and was employed, and served under Captain Oglesby in driving a waggon & team to, and from, Richmond, and many other places in supplying our own troops and the British prisoners, then at Albemarle Barracks with provisions - That he served under said Captain Oglesby, at and near, said Albemarle Barracks Va at best eight months and was discharged by him - with the line of the army, he has no recollection of the General or field officers in Command near where he served.

That in the Spring of the year 1781 he marched from the said County of Fluvanna in a Company of Militia under Captain Daniel Tilman to Richmond - That said Captain Tilman was either arrested or discharged and sent home, when he was attached to Captain Millers Company. that after remaining in Captain Millers company a few weeks, he joined a Company of Light Infantry under Captain Woodfin, and served under Captain Woodfin the balance of the tour, three months in all, in the neighborhood of Williamsburg. That during the whole of this three months service he was in Col Daburgs Regiment, except a part of the time that he was in Capt Woodfins Company of Light Infanty, he was more immediately under the Command of Major Boyce - That he served during the revolutionary War altogether Eleven Months, for which he claims a pension - that he never received a Written discharge - That the Caps with which he served were called into service (so far as he know) by competent authority. That he was either garrison for the line during which the Service was performed, and that he was not employed in any civil pursuit. That he was born in the said County of Fluvanna, agreeable to his register now in his possession on the 8th March 1763 That he resided in the said County of Fluvanna, at the time he went into service, and has resided therin nearly the whole of his lifetime since, and still resides ther - that John Haislip, Daniel Thacker, John Brashaw, Austin Seay and Benjamin Woody, are persons to whom he is known and who can testify as to his character for surity and there belief of his services as a soldier of the revolution.

He hereby, relinquishes every claim whatsoever to a pension or annuity except the present, and declares that his name is not on the pension roll of the agency of any state. Sworn and subscribed the day and year aforesaid -

Affidavits as follows

John Haislip a credible person this day personally appeared before me John Winn a Justice of the pearce for the County of Fluvanna and made oath that in or about the year 1780, he was on his way to join the army stationed at Albemarle Barracks in the County of Albemarle Va and saw, the above named Pearce W Melton, mear that place driving one of the publick waggons and teams, with provisions for the troop, stationed there

That in the year 1781 the said Melton marched from the County of Fluvanna with him,in a Company under Captain Daniel Tilman to Richmond. that Captain Tilman was discharged and sent back home, That said Melton with this affiant was then transferred to some other Company not particularly recollected and served all together as well as he can recollect about three months. That this service was rendered in the lower part of Virginia near Williamsburg, under Col. Dabney and Major Boyce. That he is the same Pearce W Melton and now resides in the said County of Fluvanna and that his statement is entitled to credit.

Daniel Thacker a respected person this day personally appeared before me and made oath, that he marched from Fluvanna with Pearce W Melton in the year 1781 under Capt Daniel Tilman in Richmond. That after Capt. Tilman's discharge they were both transferred to other companies not particularly recollected. That he is well satisfied the said Melton served the months and this tour -

John Bashaw a credible person this day states upon oath before me John Winn a Justice of the Peace for Fluvanna County. that he also marched with said Pearce W Melton from Fluvanna to Richmond in Capt Daniel Tilmans Company during the Revolutionary War. That this affiant then enlisted in teh continental service and left said Melton in said company at Richmond and therefore cannot say more - than he thinks said Meltons statement is entitled to credit - That he had known him ever sence, and that he is the same man, & still resides in Fluvanna

Austin Seay having religous thoughts about taking an Oath, Solemly offerith and saith - That he saw Pearce W Melton in Service at Richmond during the Revolutionary War, but cant say under what officers he served or how long

The said Austin Seay is a credible person and subscriber and offerunto the above before me this 21st day of August 1833

We Walker Timberlake - a Clergyman residing in the County of Fluvanna and James Stratton - residing in the same County, do hereby certify that we are well acquainted with Pearce W Melton who has subscribed and Sworn to the foregoing declaration, that we believe him to be Seventy years of age, that he is reputed and believed in the neighborhood, where he resides to have been a soldier of the revolution, and that we concur in that opinion - Sworn and subscribed this day and year aforesaid

And the said Court do hereby declare their opinon after the investigationof the Matter, and after poling the interrogatories presented by the war department, that the above named applicant was a revolutionary soldier and served as he states, and the said Court further certifies that it appears to them that Walker Timberlake who has signed the preceding certificate is a clergyman resident inthe said County of Fluvanna, and that James Stratton who has also signed the same, is a resident of the same county and is a credible person, and that this statement is entitled to credit.
